SWEEPSTAKES PERIOD: The Fidelity FIDO Sweepstakes (the “Sweepstakes”) begins 12:00 a.m. Eastern Time (“ET”) on 7/18/2023 and ends 11:59 p.m. ET on 7/31/2023 (“Sweepstakes Period”). ELIGIBILITY: This Sweepstakes is open to legal residents of the 48 contiguous United States and D.C., 18 years of age or older as of date of entry. The following individuals are not eligible to enter or win: Officers, directors, independent contractors, sub-contractors, and employees of Fidelity Brokerage Services LLC ("Sponsor"), Halo Branded Solutions (“Promotion Administrator”) and any officers, directors, independent contractors, sub-contractors or employees of Sponsor parent companies (as applicable), subsidiaries and affiliated companies; their distributors, contractors, web design, advertising, fulfillment, and promotional agencies; and other individuals or entities involved in the administration, development, fulfillment and execution of the Sweepstakes (collectively, the “Sweepstakes Entities”) and all of such persons immediate family members (e.g. spouse, parent, child, sibling, in-laws and/or the “steps” of each) as well as any non-related household members of each); employees and registered associates of FINRA firms, government officials and employees including managers and administrators of public universities and health care facilities. The Sweepstakes is intended solely for viewing and participation in the United States and shall be construed and evaluated solely under United States federal, state and local laws. The Sweepstakes is void where prohibited, taxed or restricted by law. Winning a prize is contingent upon fulfilling all requirements set forth herein.

All Entries submitted shall herein also be referred to as the “Entry” or “Entries.” Limit of one (1) Entry per person. Whether an entrant is eligible to participate in the Sweepstakes is a determination made in the sole discretion of the Sponsor. Sponsor may void and render ineligible any entrant that Sponsor determines in its sole discretion to have violated or attempted to violate or subvert the Sweepstakes Official Rules or applicable policy, rule, law, or regulation. The Sweepstakes Entities are not responsible for late, incomplete, invalid, unintelligible, illegible, damaged, misdirected, returned Entries, which will be disqualified, or lost, interrupted, or unavailable network, server, or other connections; or miscommunications, computer or software malfunctions, telephone transmission problems, technical failures, garbled transmissions, damage to a user's mobile device/computer equipment (software or hardware), or other errors or malfunctions of any kind, whether human, mechanical, electronic or otherwise. Proof of submission will not be deemed to be proof of receipt by Sponsor. The "authorized account holder" is the natural person assigned an email address by an Internet access provider, online service provider, Internet service provider, or other organization (which may include an employer) responsible for assigning email addresses for the domain associated with the submitted address. Potential winning entrant(s) may be required to show proof of being the authorized account holder. Entries specifying an invalid, non-working, or inactive email address will be disqualified and ineligible to win. Entries will not be judged.
Sponsor reserves the right in its sole and unfettered discretion to disqualify any Entry that it believes does not comply with these Official Rules or that is not consistent with the spirit or theme of the Sweepstakes. No information regarding Entries, other than as otherwise set forth in these Official Rules will be disclosed.
RANDOM DRAWING: The winners will be selected in a random drawing to be held on or about 8/2/2023 from among all eligible Entries received during the Sweepstakes Period. The random drawing will be conducted by the Promotion Administrator,. By submitting an Entry, entrants agree that the decisions of the Sponsor and the Promotion Administrator are final and binding on all matters relating to the Sweepstakes. The odds of winning a prize depend on the total number of eligible Entries received in accordance with these Official Rules. PRIZE: Up to sixty-nine (69) FIDO Prizes packs (Estimated Retail Value $49.20) Will consist of: Leash, Tennis Ball, Collapsible Dog Bowl, Dog Sweatshirt, Dog Bandana. Prize is non-transferable. Entrants agree to comply with all applicable federal, state and local taxes and further agree that any tax liability or information is sole responsibility of the entrant. NOTIFICATION OF WINNER: The potential winners will be notified of their selection as a potential recipient of a prize via email by Sponsor (or Promotion Administrator on Sponsor’s behalf). Entrants must agree to comply with reasonable requests of Sponsor/Administrator to provide personal information, contact information and supporting documentation sufficient to identify Entrant and verify that Entrant is eligible and has complied with all requirements of the Sweepstakes, including the Official Rules, and all applicable rules, laws, and regulations. Entrants who do not sufficiently reply to an email seeking such information within seventy-two (72) hours may be disqualified. Sponsor and Promotion Administrator assume no responsibility for direct messages, emails or other communications with entrants that are undeliverable or unread or inaccurate for any reason, including technical issues that result from entrant or third-party settings or activity. Potential winner is subject to verification by Sponsor or Administrator, and verification of potential winner is final and binding in all matters related to the Sweepstakes. Sponsor reserves the right to perform a background check, internet, and/or social media review on the potential winner, who agree to provide any verification or authorizations necessary in connection with background check. Sponsor will have the right, in its sole discretion, to disqualify any potential winner if the background check, internet, and/or social media review on such winner reveals conduct, information or history that, in Sponsor’s determination, may be harmful to Sponsor or Sponsor’s image or reputation or with which Sponsor does not wish to be associated.
LIMITATIONS OF LIABILITY: The Sweepstakes Entities are not responsible for lost, late, delayed, inaccurate, incomplete, or misdirected Entries, interrupted or unavailable network/app servers involved processing Entries, app/internet access or other connections, miscommunications, failed telephone or computer transmissions/failures of any kind or jumbled, scrambled or misdirected Entries, or for phone, electrical, network, computer hardware or software or program malfunctions, inability to upload or download any information in connection with participating in the Sweepstakes, failures or difficulties or for other errors, omissions, interruptions, or deletions of any kind whether human, mechanical or electronic or for any damage to any person or person’s computer/device or property related to participating in the Sweepstakes. Persons found tampering with, abusing any aspect of this Sweepstakes, or violating these Official Rules, will be disqualified and may be subject to prosecution. CAUTION: ANY ATTEMPT TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. SHOULD SUCH AN ATTEMPT BE MADE, THE SWEEPSTAKES ENTITIES RESERVE THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW. In the event of a dispute as to the identity of a winner or Social Media Entry, the winning Entry will be declared made by the authorized account holder of the email address associated with the entrant’s Twitter or Instagram account. “Authorized email account holder" is defined as the natural person who is assigned to an email address by an Internet access provider, online service provider or other organization (e.g., business, educational institution, etc.) that is responsible for assigning email addresses for the domain associated with the submitted email address. Potential winner may be required to show proof of being the authorized account holder associated with the Entry. IN NO EVENT WILL SWEEPSTAKES ENTITIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF PARTICIPATION IN THIS GIVEAWAY OR ACCEPTANCE OR USE/MISUSE OF PRIZE.
GENERAL CONDITIONS: By entering this Sweepstakes and/or accepting the prize as the selected winner, each entrant/winner agrees that they have read these Official Rules and will be strictly bound by them. Sponsor has sole discretion to determine whether an entrant has violated or attempted to violate the Official Rules in any way and entrant agrees that Sponsor's decisions shall be final in all matters pertaining to this Sweepstakes and the prize awarded. By accepting prize, entrant grants Sponsor the right to use their individual name, address, photograph, and likeness for advertising, publicity, marketing and promotional purposes and for any other such purposes as Sponsor so determines, in any and all media worldwide without limitation, without further compensation or permission, except where prohibited by law. All federal, state and local laws apply. Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures, viruses, tampering, or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to cancel, terminate, modify or suspend the Sweepstakes and award the prize in a random drawing from among all eligible Entries received prior to cancellation. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or in an unsportsmanlike or disruptive manner. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. No more than the stated prize will be awarded.
PRE-DISPUTE ARBITRATION CLAUSE: For all controversies that may arise between entrant on the one hand and the Sweepstakes Entities on the other hand (for purposes of this clause, the “Parties”) that arise out of the Sweepstakes, the Parties agree that (1) All parties to this agreement are giving up the right to sue each other in court, including the right to a trial by jury, except as provided by the rules of the arbitration forum in which a claim is filed; (2) Arbitration awards are generally final and binding; a Party’s ability to have a court reverse or modify an arbitration award is very limited; (3) The ability of the Parties to obtain documents, witness statements, and other discovery is generally more limited in arbitration than in court proceedings; (4) The arbitrators do not have to explain the reason(s) for their award unless, in an eligible case, a joint request for an explained decision has been submitted by all Parties to the panel at least 20 days prior to the first scheduled hearing date; (5) The panel of arbitrators will typically include a minority of arbitrators who were or are affiliated with the securities industry; (6) The rules of some arbitration forums may impose time limits for bringing a claim in arbitration. In some cases, a claim that is ineligible for arbitration may be brought in court; and (7) The rules of the arbitration forum in which the claim is filed, and any amendments thereto, shall be incorporated into this agreement.
The Parties further agree that all controversies arising out of the Sweepstakes, including but not limited to any Entries intended by one of the Parties to be submitted to the Sweepstakes, shall be determined by arbitration through the Financial Industry Regulatory Authority (“FINRA”) or any United States securities self-regulatory organization or United States securities exchange of which the person, entity or entities against whom the claim is made is a member, as you may designate, to be held at a location in New York, New York. If you commence arbitration through a United States self-regulatory organization or United States securities exchange and the rules of that organization or exchange fail to be applied for any reason, then you shall commence arbitration with any other United States securities self-regulatory organization or United States securities exchange of which the person, entity or entities against whom the claim is made is a member. If you do not notify us in writing of your designation within five (5) days after such failure or after you receive from us a written demand for arbitration, then you authorize us to make such designation on your behalf. The commencement of arbitration through a particular self-regulatory organization or securities exchange is not integral to the underlying agreement to arbitrate. You understand that judgment upon any arbitration award may be entered in any court of competent jurisdiction. No person shall bring a putative or certified class action to arbitration, nor seek to enforce any predispute arbitration agreement against any person who has initiated in court a putative class action; or who is a member of a putative class action who has not opted out of the class with respect to any claims encompassed by the putative class action until: (i) the class certification is denied; or (ii) the class is decertified; or (iii) the customer is excluded from the class by the court. Such forbearance to enforce an agreement to arbitrate shall not constitute a waiver of any rights under this agreement except to the extent stated herein.
ANY AND ALL CLAIMS, JUDGMENTS AND AWARDS SHALL BE LIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTS ASSOCIATED WITH ENTERING THIS SWEEPSTAKES BUT IN NO EVENT ATTORNEYS’ FEES; AND UNDER NO CIRCUMSTANCES WILL ENTRANT BE PERMITTED TO OBTAIN AWARDS FOR, AND ENTRANT HEREBY WAIVES ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL AND CONSEQUENTIAL DAMAGES AND ANY OTHER DAMAGES, OTHER THAN FOR ACTUAL OUT-OF-POCKET EXPENSES, AND ANY AND ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR OTHERWISE INCREASED. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU.
PRIVACY: Any personally identifiable information collected during your participation in this Sweepstakes will be collected by the Sweepstakes Entities and used by it and its agents for purposes of the proper administration and fulfillment of the Sweepstakes as described in these Official Rules, and in accordance with Sponsor's Privacy Policy, posted at https://www.fidelity.com/privacy-policy and Promotion Administrator’s Privacy Policy posted at https://halo.com/privacy-policy/
GENERAL RELEASE: Each entrant hereby agrees to release, indemnify, and hold harmless the Sweepstakes Entities, from any claims, actions, damages, losses or injury of any kind including but not limited to personal injury or death, resulting from participating in the Sweepstakes or from acceptance, use or misuse of a prize awarded or participation in any prize-related activity. This limitation of liability is a comprehensive limitation of liability that applies to all damages of any kind, including (without limitation) compensatory, direct, indirect, or consequential damages; loss of data, income, or profit; loss or damage to property; and/or claims of third parties. Entrants agree that the Sweepstakes Entities have not made nor are in any manner responsible or liable for any warranty, representation, or guarantee, statutory, express, or implied (including but not limited to the implied warranties of merchantability, title, and fitness for a particular purpose), in fact or in law, relative to the Sweepstakes or to the prize. Under no circumstances should entrants give a Fidelity account number, or any information regarding their account, over the phone or via mail, in connection with this Sweepstakes. Participants acknowledge and agree to share their email address with Fidelity, which may be used for future marketing purposes.
